The user expressly accepts these General Terms and Conditions, which will govern the contractual relations established between the User and the entity GESTION GOLF DEL SUR S.L.U., with CIF B38572939 and address at Avenida Galván Bello, Casa Club S/N Urbanización Golf del Sur, 38639, San Miguel de Abona Tenerife, regarding the GREEN FEES sales service through the website www.golfdelsur.es.
These General Conditions have been prepared in accordance with the provisions of Law 7/1998, on General Contracting Conditions, Law 26/84 on the Defense of Consumers and Users, Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, Law 7/96 on the Regulation of Retail Trade, Law 34/2002 on Information Society Services and Electronic Commerce and other applicable legal provisions on the matter.
By accepting these General Conditions, the User/Client expressly accepts full and unreserved adherence to them, as well as to the Particular Conditions that regulate the use of the contracted services, declaring that they have the legal capacity to contract the services offered through the website. This document may be printed and stored by users, and they may also request any clarification of its content by calling 676076903 / 619757364 or by emailing golfdelsur@golfdelsur.es.
GOLF DEL SUR may modify these General Conditions at any time and without prior notice, by publishing said modifications on its website so that they may be known to Users. With the publication of the modifications made on the website, the obligation to notify Users of them will be deemed to have been fulfilled.
To access the contracting of the services offered on the website, the User must first complete all the data requested in the form established for this purpose, and press the ACCEPTANCE button.
2.1 Contracting: The parties expressly declare that acceptance of the GOLF DEL SUR offer selected by the User/Client will occur with the completion by the User of all the steps of the contracting procedure detailed on the website, which implies the full and express acceptance of these conditions.
The contract will be concluded when the bank associated with the credit card provided by the Client authorizes the transaction. At this time, a confirmation page of the reservation made will appear, which can be printed as proof of the same.
By accepting the contract, the client expressly accepts both the general rules of the game required, as well as the particular rules determined by the golf course where the client purchases the green fee or golf package.
The conditions and rates of the services offered are those that appear on the website at the time of contracting them. GOLF DEL SUR may freely modify the rates without prior notice by publishing them on the website. These rates will include the IGIC or the tax that, where applicable, replaces it, at the rate of tax established in each case by current legislation.
2.2. Golf services: The user/client must respect the operating and organisation rules established by the golf course. Acceptance of the offer by the user implies express acceptance on their part of said rules.
When contracting golf services, special consideration must be given to the federation regulations governing this sport, and in particular the following issues:
HANDICAP: some golf courses may require a minimum handicap from the player, which must be proven at the time of booking as well as at the course itself.
GREEN FEES: the green fee prices published on the website may vary in the event of a change in the rates in force at the date of issue by the Golf Course.
Cancellation of the green fee or package contracted by the user with less than 15 days’ notice will entail charges of 100% of its cost.
In the event of not showing up at the course at the time and day set, the user will not be entitled to any refund of the amount. If the agreed services cannot be provided due to force majeure (adverse weather, course closure, repairs,) the full amount of the service will be refunded upon proof of such circumstances.

GOLF DEL SUR declares that it complies with current regulations regarding data protection, Organic Law 3/2018, of December 5, on the Protection of Personal Data and the guarantee of digital rights and development regulations, and Users may exercise their right to access, rectify and cancel the data provided through the means of contact referred to in the previous paragraph.
Users may also consult the company’s privacy policy in PRIVACY.
These General Terms and Conditions shall be governed by Spanish law. In the event of any dispute or claim between the parties in relation to the fulfilment or content of these General Terms and Conditions, the parties agree to submit to the Courts and Tribunals of Santa Cruz de Tenerife.
